DMCA Policy


It is the policy of Computer Country, an Online Service Provider under Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"), to respond to clear notices of alleged copyright infringement.

On this page we will try to lay out the steps needed to make submitting notices of alleged infringement or counter notifications to Computer Country as straightforward as possible.

Our response to a valid infringement notification will be to remove the content and/or terminate the subscriber within 48 hours of receipt of the infringement notification unless we have received a counter notification.  Computer Country  will make a good faith effort to contact the owner or administrator of the allegedly infringing site or content.  On receipt of a valid counter notification Computer Country will restore the content and/or restore the subscriber service within 10 to 14 days.

 


Infringement Notification


To submit an infringement notification with us you need to mail for fax the information specified below.  Remember you will be responsible for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is infringing your copyrights.  If you have any questions about this process please consult an attorney.

To make it easier for us to process please submit your notification in the following format including section numbers:

  1. Identify in sufficient detail the copyrighted work that you believe has been infringed upon.
  2. Identify the material that you claim is infringing the copyrighted work listed in item #1 above or which you claim is the subject of infringing activity. You must identify each separate item of infringing material.
  3. Provide enough information for Computer Country to be able to contact you.  (email address, phone number)
  4. Provide enough information for Computer Country to be able to identify the owner/administrator of the allegedly infringing material.
  5. Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."
  6. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  7. Sign and date the paper.
  8. Send the written communication to the following address:

Counter Notification


The administrator of an affected site or the provider of affected content may, pursuant to sections 512(g)(2) and (3) of the DMCA, submit a counter notification.  To submit a counter notification with us you need to mail for fax the information specified below.  Remember that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others.  If you have any questions about this process please consult an attorney.

To make it easier for us to process please submit your notification in the following format including section numbers:

  1. Identify the specific web site or other unique identifying information of material that Computer Country has removed or to which Computer Country has disabled access.
  2. Provide your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or Jackson County, Oregon if your address is outside of the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  3. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that each item of content or service identified above was or will be removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled, or that the material identified by the complainant has been removed or disabled at the location of content or service identified and will no longer be accessible."
  4. Sign and date the paper.
  5. Send the written communication to the following address:
